Terms & Conditions
1. Scope
These General Terms and Conditions (AGB) apply to all orders placed through the PropShop online store (propshopfpv.de), operated by Toren Gebauer, Heinrich-Gadertz-Weg 5, 23562 Lübeck, Germany. By placing an order, you agree to these terms. These terms apply to consumers within the meaning of § 13 BGB.
2. Contract Formation
The product listings on our website constitute a non-binding invitation to submit an offer (invitatio ad offerendum). By completing the checkout process and clicking "Place Order", you submit a binding purchase offer. We accept the offer by sending an order confirmation email. The purchase contract is formed upon receipt of this confirmation.
3. Prices and Shipping Costs
All prices shown on our website include statutory value-added tax (VAT). Shipping costs are displayed separately during checkout before you submit your order. We ship within the EU. The applicable shipping costs depend on the destination country and are shown during checkout.
4. Delivery
We ship from within the EU. Delivery times are typically 1–3 business days for Central Europe (Germany, Austria, Czech Republic, etc.) and 3–5 business days for other EU countries. These are estimates, not guarantees. Orders are processed and dispatched on business days (Monday–Friday). We will notify you by email when your order has been shipped.
5. Payment
We accept the following payment methods: credit card (Visa, Mastercard) via Stripe, PayPal, and other EU payment methods as shown during checkout. Payment is due at the time of placing the order. All payment processing is handled by our payment service provider (Stripe) in a PCI-compliant environment.
6. Right of Withdrawal
As a consumer in the EU, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you or a third party designated by you (other than the carrier) receives the goods. To exercise your right of withdrawal, you must inform us (Toren Gebauer, Heinrich-Gadertz-Weg 5, 23562 Lübeck, Germany, crew@propshopfpv.com) of your decision to withdraw by means of a clear statement (e.g. an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.
7. Model Withdrawal Form
To: Toren Gebauer, Heinrich-Gadertz-Weg 5, 23562 Lübeck, Germany, crew@propshopfpv.com I hereby give notice that I withdraw from my contract of sale of the following goods: Ordered on / received on: Name of consumer: Address of consumer: Signature of consumer (only for paper form): Date:
8. Returns and Refunds
If you exercise your right of withdrawal, we will refund all payments received from you, including the delivery costs (except supplementary costs if you chose a delivery method other than the least expensive standard delivery offered), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment you used for the initial transaction. You must return the goods without undue delay and no later than 14 days from the day on which you communicate your withdrawal. The goods must be unused and in their original packaging. The direct cost of returning the goods is borne by you.
9. Warranty
Statutory warranty rights apply as provided by German law (§§ 434 ff. BGB). If a product is defective upon delivery, you are entitled to repair, replacement, or — if those remedies fail — reduction of price or rescission of the contract. The limitation period for warranty claims is two years from delivery of the goods.
10. Limitation of Liability
We are liable without limitation for damages caused by intentional or grossly negligent conduct, for injury to life, body, or health, and under mandatory statutory provisions such as the Product Liability Act. For slight negligence, we are liable only in cases of breach of a material contractual obligation (cardinal obligation), and liability is limited to foreseeable, typically arising damages. This does not affect your statutory rights as a consumer.
11. Governing Law
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in the EU, you also enjoy the protection of the mandatory consumer protection provisions of your country of residence.
12. Dispute Resolution
The European Commission provides an online dispute resolution (ODR) platform at: https://ec.europa.eu/odr
